MedPay

Georgia is a “fault” state which means that anyone involved in an accident will need to go through their own insurance to pay for treatment and other bills stemming from the accident. If you only have liability coverage, it will pay for the other driver’s expenses if you caused the accident, but it won’t pay for your medical expenses.

MedPay is an optional coverage you can add to your auto insurance policy which will typically be the first to pay for any health-related expenses after an accident, even if you’re at fault.

Although those policies will cover your medical bills, Georgia uses the modified comparative negligence principle which means that the amount you receive may be reduced by your percent of fault in the accident, as long as it’s less than 50%.

For example, if you were found to be 20% at fault and your medical expenses were $100,000, your compensation will be reduced by $20,000 to $80,000. 

Health insurance

Your health insurance might provide all the coverage you need, regardless of MedPay coverage or your percentage of fault in the accident. However, if you recover a financial settlement, they might require reimbursement for the amounts they paid for your treatment.  

Medicare
